First and foremost, on behalf of the Bukit Jelutong Residents Association (BJRA), I would like to extend our warmest wishes to all of you – Selamat Hari Raya Aidilfitri. May this festive season bring abundant joy and happiness to you and your loved ones. As we bask in the festive spirit, it is with great enthusiasm that I share a significant milestone that marks a new chapter for our cherished community. Following extensive discussions and with the steadfast support of the majority of Bukit Jelutong's precincts' resident associations (RAs), we have reached a comprehensive and amicable settlement with Sime Darby Property concerning the future of the area where Tiara Residence will be built on strictly on goodwill and without any admission to liability basis. In the spirit of transparency and with a commitment to keeping you all informed, here is a summary of the key points which has essentially been agreed upon with Sime Darby Property (the details of which would be subject to their Management / BOD Approval), all of which are aimed at enhancing our community's living experience:  1.⁠ ⁠Clubhouse Construction: SDP(BJ)SB will construct a clubhouse at D'Bayu Park, adjacent to a football field, with the design and budget to be approved by SDP(BJ) SB's management in due course. Upon completion, the clubhouse will be handed over to BJRA.  2.⁠ ⁠Guard House(s): To address security concerns and the lack of utility services due to unapproved guard houses, SDP(BJ)SB will assist BJRA by hiring a consultant to facilitate obtaining MBSA's approvals and providing a one-off fund of RM10,000 to relevant RAs upon certain conditions being met.  3.⁠ ⁠Fencing for Selected Precincts: SDP(BJ)SB agrees to aid in constructing or repairing fences around selected precincts on a goodwill basis, including appointing a consultant for inspections and offering a one-off financial fund of RM10,000 to each identified RA under specified conditions.  4.⁠ ⁠Walkways Repair: SDP(BJ)SB will appoint a consultant to inspect and report the condition of the damaged walkways in Bukit Jelutong, though any repair work is subject to MBSA's approval.  5.⁠ ⁠D'Bayu and D'Vida Buildings: Acknowledging that the maintenance responsibility for these buildings has transferred to their respective Joint Management Bodies, SDP(BJ)SB will provide financial assistance for D'Bayu Building's repairs and undertake upgrading works and for D'Vida Building, converting a manmade pond into a green area, subject to residents' term sheet.  6.⁠ ⁠Additional Exit for Tiara Residence: SDP(BJ)SB plans to create an emergency exit from the Project area, bypassing the main roundabout to alleviate traffic congestion.  7.⁠ ⁠Security During Construction: SDP(BJ)SB commits to continuing security patrols in areas under its development and appointing a separate security service for the construction site.  8.⁠ ⁠Withdrawal of Appeal: BJRA agreed to formally withdraw any appeals against SDP(BJ)SB, with no costs or liberty to refile.  9.⁠ ⁠Public Access to Tiara Jelutong Recreational Areas: SDP(BJ)SB agrees to keep the green area and lake within the Project site open to the public for recreational use. 10.⁠ ⁠Maintenance of Existing Ponds: SDP(BJ)SB will undertake desilting work for retention ponds (north and south pond), pending MBSA's approval. The above terms have been carefully negotiated and reflected in a Term Sheet executed between Sime Darby Property and BJRA (with the agreement and support of all the relevant RAs) to ensure that it reflects the interests and enhances the well-being of our community. It is a testament to what we can achieve together through dialogue, collaboration, and a shared vision for the future of Bukit Jelutong. We are also pleased to note Sime Darby Property’s commitment to listen and accede to the community’s wishes notwithstanding the fact that they were not legally obligated to carry out the relevant steps or make the contributions as stated above. As we progress, the BJRA remains committed to representing your interests and ensuring this term sheet brings tangible benefits to our community.
